Terms of service

1. General

1. These Terms of Sale set out the rules for selling products (in particular garden saunas, cold plunge tubs, hot tubs, garden showers and sauna accessories) and providing related services (transport, installation) through the online store at wypoc.com (the "Store").

2. The Store is operated by WYPOC Sp. z o.o., ul. Wola 1/2, 38-480 Rymanów, Poland, registered in the Register of Entrepreneurs of the Polish National Court Register (KRS) kept by the District Court in Rzeszów, 12th Commercial Division, under KRS no. 0001253578, VAT/tax ID (NIP): 6842689666, REGON: 545229568, share capital PLN 50,000.00 (the "Seller", "we", "us").

3. How to contact us: e-mail: kontakt@wypoc.com, phone: +48 535 745 515 (Mon–Sat, 8:00–18:00 CET), postal address: ul. Wola 1/2, 38-480 Rymanów, Poland; warehouse address (returns and complaints): ul. Żwirki i Wigury 15, 38-400 Krosno, Poland.

4. These Terms apply to both consumers and business customers. Where the law of your country grants the same protection, the provisions for consumers also apply to a sole trader who buys for purposes that are not of a professional nature for their business (a "sole trader with consumer rights").

5. To use the Store you need a device with internet access, an up-to-date web browser with JavaScript and cookies enabled, and an active e-mail address.

6. You must not submit any unlawful content through the Store.

2. Definitions

Customer – a natural person, legal person or organisation placing an order in the Store.

Consumer – a Customer who is a natural person buying for purposes that are not directly related to their business or profession.

Goods – products presented in the Store, including a garden sauna with the selected package.

Package – a version of the sauna offer that defines the scope of delivery and additional services (e.g. Installation A–Z, SPA); the contents of each package are described on the product page.

Order – the Customer's declaration of intent to conclude a sales contract.

Contract – the contract for the sale of Goods and, for packages that include installation, also the contract for the installation service, concluded between the Customer and the Seller.

3. Countries we serve

1. We deliver to Norway, Sweden, Finland and Germany. Delivery to other countries is possible on request – please contact us before ordering.

2. If your delivery address is in a country we do not normally serve, we will contact you to confirm whether and on what terms we can deliver. If we cannot, we will cancel the order and refund any payment in full.

4. Placing an order and concluding the contract

1. Information about Goods in the Store (description, photos, price) is an invitation to conclude a contract.

2. To place an order, select the Goods (and the Package, if applicable), add them to the cart, enter the details needed to fulfil the order (full name or company name, delivery address, e-mail, phone number and, if you need an invoice, company details and VAT number), choose a payment method and accept these Terms.

3. The Contract is concluded when you click the "Pay now" button (or a button with equivalent wording) after accepting these Terms.

4. Immediately after you place the order, we send an order confirmation together with these Terms to the e-mail address you provided.

5. Because saunas and tubs are large items, we will contact you by phone or e-mail to agree the delivery date, delivery conditions and, where relevant, installation.

5. Prices, taxes and payment

1. Prices in the Store are shown in your local currency. The final price, including any delivery costs known at the time of ordering, is shown before you place the order and is binding at that moment.

2. Customers in EU countries: prices include VAT at the rate applicable in your country, as shown at checkout.

3. Customers in Norway and other countries outside the EU: Goods are shipped DAP (Delivered at Place, Incoterms® 2020). Prices do not include Norwegian import VAT, customs duties or customs clearance fees, which are payable by the Customer on import, unless we have expressly agreed otherwise. We will provide the documents needed for customs clearance.

4. Payment methods:

a) payment card via the secure checkout;

b) bank transfer against a pro forma invoice or invoice – the bank details and the payment deadline (7 days from the order unless agreed otherwise) are stated on the document we send you.

5. If an order is not paid within 7 days of being placed, we may cancel it and will inform you by e-mail.

6. We issue an invoice for every order. You agree to receive invoices electronically at the e-mail address you provided.

0% VAT for business customers

We are registered for intra-EU trade (EU VAT number PL6842689666, active in VIES).

  • Businesses in the EU (e.g. Germany, Sweden, Finland): if you give us your company's valid EU VAT number (checked in VIES) before you pay, we invoice the goods at 0% VAT as an intra-community supply. You account for VAT in your own country (reverse charge). The goods must be delivered to an address in another EU country, and we will ask you to confirm receipt.
  • Outside the EU (e.g. Norway, Switzerland, the United Kingdom): goods are exported from Poland at 0% Polish VAT, based on the customs export clearance. Import VAT, duties and clearance fees in your country are paid by you on import (DAP), unless agreed otherwise.
  • How to order at 0% VAT: write to us (chat or kontakt@wypoc.com) with your company name, address and VAT number before ordering. We send a pro forma invoice for bank transfer with the price at 0% VAT.
  • Price for businesses: you pay the price shown on our website excluding VAT, i.e. the website price divided by 1.23. Example: €12,300 on the website = €10,000 for your company.

Without a valid EU VAT number, orders from the EU are invoiced with VAT as shown at checkout.

6. Delivery and lead times

1. Delivery costs:

a) saunas, cold plunge tubs and hot tubs – delivery to Norway, Sweden and Finland starts from €1,000 (the amount in your currency is shown at checkout or confirmed by us). The exact cost depends on the delivery address and is confirmed with you individually before shipping. For other countries, the delivery cost is quoted on request;

b) accessories – shipped by courier; the cost is shown at checkout or confirmed by us before shipping.

2. Lead times, counted from the day your payment is received:

a) accessories – dispatched within 3 business days;

b) saunas and tubs in stock – dispatched within 48 hours (2 business days); the exact delivery and installation date is agreed with you by phone or e-mail;

c) if Goods are temporarily unavailable, we will tell you before accepting payment and give you the expected lead time.

3. Transit time depends on the destination country and is confirmed when we agree the delivery date.

4. Saunas and tubs are delivered by truck with a crane (HDS). If you have ordered a package that includes installation, our crew delivers and installs the sauna, usually within one working day. Installation covers assembling the structure, connecting the heater to the electrical connection you have prepared and starting the sauna. The availability of installation outside Poland and its cost are confirmed individually.

5. You must provide: access to the installation site for a delivery truck with a crane, a stable, level base and an electrical connection meeting the heater's requirements (for a 9 kW heater – 400 V). The electrical connection must be prepared by a qualified electrician in line with local regulations.

6. We are not responsible for delays caused by failure to meet the conditions in paragraph 5 or by customs clearance that is the Customer's responsibility.

7. Receiving the Goods

1. On delivery, please check the shipment in the carrier's presence. If anything is damaged, we recommend noting the damage in a damage report and taking photos – this helps us handle your complaint quickly. Not having a damage report does not affect a Consumer's rights in respect of lack of conformity.

2. After installation, the Customer and the installation crew sign an acceptance report confirming that the sauna has been installed and started.

8. Right of withdrawal (Consumers and sole traders with consumer rights)

1. If you are a Consumer in the EU/EEA (including Norway), you may withdraw from the Contract without giving any reason within 14 days: a) for Goods – from the day you (or a person you name, other than the carrier) take physical possession of them; b) for the installation service – from the day the Contract is concluded.

2. To withdraw, send us a clear statement before the deadline to kontakt@wypoc.com or by post to the Seller's address. You may use the model form in Annex 1, but you do not have to. We will promptly confirm receipt by e-mail.

3. You must return the Goods to WYPOC Sp. z o.o., ul. Żwirki i Wigury 15, 38-400 Krosno, Poland, no later than 14 days after withdrawing from the Contract.

4. You bear the direct cost of returning the Goods. Accessories can be returned by any courier. Saunas, cold plunge tubs and hot tubs cannot be sent by post because of their size and weight – they must be returned by truck. At your request, we can arrange collection at cost; we will give you a cost estimate in advance. As a guide, return transport from Scandinavia is of a similar order to the delivery cost (from €1,000).

5. We will refund all payments received from you, including the cost of the cheapest standard delivery offered in the Store, within 14 days of receiving your withdrawal statement, using the same payment method you used, unless you agree to another method at no cost to you. We may withhold the refund until we have received the Goods back or you have provided proof that you have sent them, whichever is earlier. Import VAT, duties and clearance fees paid by you to the authorities of a non-EU country are not paid to us and are not refunded by us; you may be able to reclaim them from your local customs authority.

6. You are liable for any reduction in the value of the Goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning (for example, heating the sauna, regular use or signs of wear).

7. Installation service: if you expressly request that installation start before the withdrawal period ends and the service is fully performed, you lose the right to withdraw from the installation service, provided you acknowledged this before installation began. If you withdraw after installation has started but before it is completed, you pay for the service in proportion to the work done up to the time you informed us of your withdrawal. You confirm your request to start installation before it begins.

8. Withdrawing from the installation service does not affect your right to withdraw from the purchase of the Goods under paragraphs 1–6. In that case, the cost of dismantling is borne by you; we will give you an estimate in advance.

9. Complaints – lack of conformity

1. We are obliged to deliver Goods that conform to the Contract.

2. Consumers in the EU: we are liable for any lack of conformity that exists at the time of delivery and becomes apparent within 2 years of delivery. You can ask for repair or replacement and, in cases provided for by law, a price reduction or termination of the Contract.

3. Consumers in Norway: you have the rights under the Norwegian Consumer Purchases Act (forbrukerkjøpsloven). You can make a complaint (reklamasjon) within 2 years of receiving the Goods, or within 5 years for Goods or parts that are intended to last substantially longer than two years – which will normally include saunas, tubs and their structural parts. You must notify us within a reasonable time after you discovered or should have discovered the defect; notification within two months of discovery is always considered timely.

4. Consumers elsewhere: you have the rights granted by the mandatory consumer law of your country of habitual residence.

5. Business customers: we are liable under the statutory warranty (rękojmia) provisions of the Polish Civil Code (Art. 556 et seq.) for 2 years from handing over the Goods.

6. You can submit a complaint by e-mail to kontakt@wypoc.com or by post to WYPOC Sp. z o.o., ul. Żwirki i Wigury 15, 38-400 Krosno, Poland. Please include your name, order number, a description of the problem, what you would like us to do and, if possible, photos.

7. We will respond to your complaint within 14 days of receiving it. If we do not respond within that time, your complaint is deemed accepted.

8. If an inspection is needed, we will agree a visit date with you. Because of the size of saunas and tubs, complaints are handled on site wherever possible, without sending the Goods back. We bear the costs of repair, replacement and transport for justified complaints.

10. Manufacturer's guarantee

1. In addition to your rights under section 9, we give a 2-year guarantee on WYPOC saunas from the day of delivery (or from signing the installation acceptance report), covering the structure, the heater and the controller with the Wi-Fi app. The scope and period of the guarantee for other Goods are given in the product description.

2. We respond to guarantee claims within 48 hours (on business days). Service visits outside Poland are arranged individually.

3. The guarantee does not cover damage resulting from: improper use or maintenance (including failure to regularly treat the wood), normal wear of consumable parts, force majeure or exceptional weather events.

4. Guarantee claims can be submitted to kontakt@wypoc.com or by phone at +48 535 745 515.

5. The guarantee does not exclude, limit or suspend a Consumer's statutory rights in respect of lack of conformity.

11. Out-of-court dispute resolution

1. If something goes wrong, please contact us first – we will do our best to find a solution.

2. Consumers in the EU can get free help and advice on cross-border disputes from the European Consumer Centre in their country (ECC-Net), and may use an alternative dispute resolution (ADR) body. Information on Polish consumer bodies is available at www.uokik.gov.pl.

3. Consumers in Norway can contact Forbrukerrådet (www.forbrukerradet.no) for advice and mediation; unresolved cases may be brought before Forbrukerklageutvalget. Forbrukertilsynet (www.forbrukertilsynet.no) supervises compliance with consumer law in Norway. Help with cross-border disputes is also available from Forbrukereuropa (ECC Norway).

12. Personal data

The way we process personal data is described in the Privacy Policy available in the Store.

13. Governing law and jurisdiction

1. These Terms and the Contract are governed by Polish law. If you are a Consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country where you have your habitual residence.

2. A Consumer may bring proceedings in the courts of their country of habitual residence or in Poland. Disputes with business customers are resolved by the court having jurisdiction over the Seller's registered office.

3. These Terms do not limit any rights a Consumer has under mandatory law.

4. We may change these Terms for important reasons (changes in the law, payment methods or delivery methods). Changes do not apply to orders placed before they take effect.

5. These Terms are effective from 26 October 2026. They are available in English, Norwegian and Polish.
